Definitions

Artist: The individual producing the commission, original art, design, content and photography, Jessica Mullis.

Client: The individual purchasing the commission, original art, design, content and photography.

Commission/Custom Original Artwork & Design: The form of service provided by the Artist to the Client per the Custom Commissioned Work Terms which is a required and legally binding agreement. “Commission,” “Art[work],” “Image[ry],” and “Project[s]” “Design[s]” “Custom Piece[s]” are used interchangeably herein and in Commission correspondence.

Terms of Service

Copyright and Reproductions: The Artist shall own the copyright in all content, images, designs and art created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Artist’s website and/or studio.

Custom/Commissioned Original Art and Design: By commissioning the Artist, the Client is purchasing the Artist’s labor only. If the Artist desired to make other uses, the Artist shall not do so without first obtaining written permission of the Client. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of the Artist.
